டெல்லி கலால் கொள்கை வழக்கு : அமலாக்கத்துறை சம்மனை எதிர்த்து முதல்வர் கெஜ்ரிவால் உயர்நீதிமன்றத்தில் மனு தாக்கல் செய்தார்

டெல்லி கலால் கொள்கை வழக்கில் முதல்வர் அரவிந்த் கெஜ்ரிவால் ஒரு சதிகாரர் என்று அமலாக்க இயக்குநரகம் (ED) முதன்முறையாக குற்றஞ்சாட்டிய ஒரு நாளுக்குப் பிறகு, AAP தலைவர் விசாரணை நிறுவனம் தனக்கு அனுப்பிய சம்மனை எதிர்த்து டெல்லி உயர் நீதிமன்றத்தில் மேல்முறையீடு செய்தார்.

கடந்த ஆண்டு அக்டோபர் மாதம் முதல் கெஜ்ரிவாலுக்கு 9 சம்மன்களை ED அனுப்பியுள்ளது. அவர் இன்னும் விசாரணைக்கு ஆஜராகவில்லை. அதன் சமீபத்திய சம்மனில், மார்ச் 21 ஆம் தேதி முன் ஆஜராகுமாறு ஏஜென்சி கேட்டுக் கொண்டது. கெஜ்ரிவாலின் மனு, நீதிபதிகள் சுரேஷ் குமார் கைட் மற்றும் மனோஜ் ஜெயின் ஆகியோர் அடங்கிய அமர்வு முன் புதன்கிழமை விசாரணைக்கு பட்டியலிடப்பட்டது.

கெஜ்ரிவால் மற்றும் ஆம் ஆத்மி சம்மன்கள் சட்டவிரோதமானது என்றும், அவை பாஜகவின் உத்தரவின் பேரில் அனுப்பப்படுவதாகவும் குற்றம் சாட்டியுள்ளனர். இந்த வழக்கில் முதல்வர் கைது செய்யப்படுவார் என ஆம் ஆத்மி கட்சியும் அச்சம் தெரிவித்துள்ளது.

முன்னதாக, சனிக்கிழமையன்று, சம்மன்களைத் தவறவிட்டதற்காக ED தாக்கல் செய்த இரண்டு புகார்களில் கெஜ்ரிவாலுக்கு டெல்லி நீதிமன்றம் ஜாமீன் வழங்கியது.

கலால் கொள்கை தொடர்பாக இரண்டு வழக்குகள், சிபிஐயால் ஒன்றும், பணமோசடி தொடர்பாக ED விசாரிக்கும் ஒரு வழக்கும் பதிவு செய்யப்பட்டுள்ளன.

இதற்கிடையில், ரூஸ் அவென்யூ நீதிமன்றத்தில் கலால் கொள்கை வழக்கை விசாரித்து வந்த சிறப்பு நீதிபதி எம்.கே.நாக்பால், வணிக வழக்குகளுக்கான மாவட்ட நீதிபதியாக தீஸ் ஹசாரி நீதிமன்றத்துக்கு மாற்றப்பட்டுள்ளார். டெல்லியின் முன்னாள் துணை முதல்வர் மணீஷ் சிசோடியா, ஆம் ஆத்மி எம்பி சஞ்சய் சிங் மற்றும் ஆம் ஆத்மி கட்சியின் முன்னாள் தகவல் தொடர்பு பொறுப்பாளர் விஜய் நாயர் ஆகியோர் இந்த வழக்கில் முக்கிய குற்றவாளிகள் மற்றும் சிறையில் அடைக்கப்பட்டுள்ளனர்.

மாவட்ட நீதிபதி (வணிகத்துறை) காவேரி பவேஜா ரோஸ் அவென்யூ நீதிமன்றத்திற்கு மாற்றப்பட்டு, கலால் வழக்கு உள்ளிட்ட எம்.பி.க்கள் மற்றும் எம்.எல்.ஏக்கள் சம்பந்தப்பட்ட வழக்குகளை விசாரிக்க நாக்பாலுக்குப் பதிலாக நியமிக்கப்பட்டுள்ளார். இந்த இடமாற்றங்கள் செவ்வாயன்று நடைமுறைப்படுத்தப்பட்ட ஒரு பெரிய பயிற்சியின் ஒரு பகுதியாகும்.

 

Delhi Excise Policy Case: Chief Minister Kejriwal filed a petition in the High Court challenging the enforcement department’s summons

A day after the Enforcement Directorate (ED) first accused Chief Minister Arvind Kejriwal of being a conspirator in the Delhi excise policy case, the AAP leader appealed in the Delhi High Court against the summons sent to him by the probe agency.

ED has issued 9 summons to Kejriwal since October last year. He is yet to appear for trial. In its latest summons, the agency asked him to appear before March 21. Kejriwal’s plea was listed for hearing on Wednesday before a bench comprising Justices Suresh Kumar Kait and Manoj Jain.

Kejriwal and the Aam Aadmi Party have alleged that the summons are illegal and are being sent at the behest of the BJP. The Aam Aadmi Party also expressed fear that the Chief Minister will be arrested in this case.

Earlier on Saturday, a Delhi court had granted bail to Kejriwal in two complaints filed by the ED for evasion of summons.

Two cases related to excise policy have been registered, one by CBI and one by ED for money laundering.

Meanwhile, Special Judge MK Nagpal, who was hearing the Excise policy case at Roose Avenue Court, has been transferred to Tees Hazari Court as District Judge for Commercial Cases. Former Deputy Chief Minister of Delhi Manish Sisodia, Aam Aadmi Party MP Sanjay Singh and Aam Aadmi Party’s former communications officer Vijay Nair are the main accused in the case and are in jail.

District Judge (Commercial Department) Kaveri Baveja has been transferred to the Rose Avenue court and replaced Nagpal to hear cases involving MPs and MLAs, including excise cases. The transfers are part of a larger exercise that took place on Tuesday.
